Accused sex trafficker Sean “Diddy” Combs was due to return to a New York courtroom Wednesday afternoon, where his lawyers will once again push for bail and pretrial freedom from “horrendous” prison conditions.
The music mogul was was arrested on Monday evening after a grand jury indicted him on three felony counts stemming from his alleged years of sexually assaulting women, federal prosecutors said.
A judge on Tuesday denied Combs bail, but his lawyers are appealing, insisting their client fits the profile of a defendant who should not be held in pretrial detention.
Combs came to New York City to surrender to government agents before his arrest, defense attorneys said. This attempt to “turn himself in” is “something the court should consider,” according to Combs’ lawyers.
Additionally, Combs said he should not be subjected to harsh conditions at a federal lockup in New York City, citing murders and suicides that have occurred at that prison in recent years.
Courts “have recognized that conditions at the Metropolitan Detention Center in Brooklyn are not appropriate for pretrial detention,” defense attorney Marc Agnifilo wrote in a letter to U.S. Magistrate Judge Robyn Tarnofsky.
“Many courts in this district have raised concerns about the appalling conditions of detention here.”
The government argued that Combs is a threat to society, based on alleged violent acts detailed in the indictment, and a flight risk because of his vast wealth.
A grand jury indicted Combs on three felony counts: extortion, sex trafficking and use of transportation to engage in prostitution, court documents showed.
